Policies, Terms and Conditions for Talisman Development Services (TDS)
1. Tuition and Fees
Prices for all services and products are subject to change at any time for any reason without prior notice. Such changes would not apply to programs or services already registered or purchased, but would apply to any new purchases or renewed registrations going forward.
2. Cancellation Policy
Once you purchase any of TDS’s online courses, paid online talks (recorded or virtual-live), or other paid materials, you will have immediate access to that purchase, and therefore such purchases are non-refundable.
3. Sequence and Timeframe for completion of a Talisman Online Course
The Registrant has 1 year to complete a course. That registration timeframe ends at the registration deadline, which is calculated from the date of initial registration for that course.
The timeframe and deadline for each course purchased is separate from that of any other course, based on each course’s respective date of initial registration.
To complete a course, all lessons and modules within that course must be completed, and such lessons and modules must be completed in sequence. You must fulfill all parts of one lesson in a module (video lesson, quiz, exercise, etc) before you can access the next lesson in the module. You must finish all lessons in a module before you can advance to the next module.
Once you complete a course, you may review any or all parts of it, in or out of sequence, as often as you want, until that course’s registration deadline.
Once the registration deadline for a course is reached, your access to that course will have to be renewed manually. You will have the option to renew your registration without losing the progress that you made previously.
4. Disclaimers
TDS IS NOT HEALTH CARE: These are NOT medical, psychiatric, psychotherapeutic or healthcare diagnostic or treatment services. These services will NOT address matters that are (deemed to be) better suited to or strictly requiring medical, psychiatric, psychotherapeutic or healthcare services. TDS services are intended to convey general information about self-understanding and circumstance-understanding for educational purposes. In situations where it provides health-educational information, it is not a substitute for nor does it replace professional healthcare advice, diagnosis, or treatment of health conditions. TDS services are not designed for use as healthcare references to formally diagnose, treat or prevent medical illness or trauma. Participating in TDS services does not create a doctor-patient relationship. The information contained in TDS services is not intended to dictate what constitutes reasonable, appropriate, or best care for any given health issue, nor does it take into account the unique circumstances that define any health issues of a client. If you have questions or concerns about the diagnosis, treatment, or prevention of a medical, physical health or mental health issue, you should always consult your personal physician or other health care professional. Please consult your physician or other health care professional for any matters related to applying any self-care program that might impact your health, to make sure it is appropriate for your needs. Do not disregard, avoid, or delay obtaining any health-related advice from your health care professional because of something you may have learned in TDS services. Current research may exist that could affect the educational information provided in TDS services, and advice found within TDS services may not be based on the most recent findings or developments. Therefore, the use of any information provided in TDS services is solely at your own discretion.
INHERENT LIMITATIONS OF TDS SERVICES: TDS offers and uses certain ideas, premises, principles and processes (IPPPs) to equip people to increase Human Capacity in their life and work. The aim of all of TDS’s services and products is to facilitate processes and experiences of learning, to encourage the exploration and discovery of implications and insights, and to foster application of all of this. The degree to which this can actually happen varies from one client to another depending on a client’s readiness, receptivity, circumstances and effort. Neither TDS’s processes nor our clients’ capacities are complete, we all are always evolving. Beyond these general objectives, and those specific outcomes that would be stipulated in a client’s particular invoice/contract, TDS cannot ultimately be responsible for the degree to which a client chooses to execute/apply Talisman’s IPPPs / learning. TDS also cannot guarantee any particular degree of actual impact or results of its services in the life or situation of a client, which ultimately rest on the choices, discretion, effort and circumstances of the client.
5. Confidentiality
Whereas TDS’s services do not constitute any form of health care, they are therefore not bound by HIPAA laws or similar state or federal healthcare regulations.
For its consulting services, TDS will honor the confidentiality and privacy of any personally identifying information that is shared by a client.
For TDS-run group activities or public fora (dialogues, Q&A, sharing) – in-person or virtual – whether stand-alone or as part of a talk, class, course, seminar, workshop, or specialized group – TDS will honor the confidentiality and privacy of any personal information that is shared in that group/forum, and will encourage a culture of respect and discretion among participants. But TDS cannot guarantee or enforce, and will not be held liable for, the impact of your choices of self-disclosure on others in a group/forum, nor can TDS guarantee or be held liable for the choices and discretion of participants outside of TDS activities.
For educational purposes, TDS may occasionally include in its teaching activities or materials a genericized version of a shared story or circumstance – keeping main features and situations generalized and nameless (or name-changed), with no connection made to actual specific people, places or situations or to the particular identifiers of participants/clients. In such cases, these generalized illustrations and stories are not personally identifying or confidential information.
TDS will not use any identification of a client publicly for any purpose, nor will TDS use any image or attributed quote of a client, without first obtaining the client’s written permission to do so. Such permissions will be obtained on a case-by-case basis; permission given for one situation, attributed quote, image or identification does not apply to others, unless the client has specifically given a standing universal written permission to do so.
6. Trademark Compliance, Intellectual Property, and Security of Registered Content
Any use of TDS’s trademarked names, phrases, logos, images, brands, product/service titles, or musical riffs without prior consent from TDS is strictly prohibited, and is subject to applicable laws, monitoring and enforcement that TDS might pursue.
TDS’s services, products, content, processes and intellectual property – be they provided live, recorded, online, via website, via social media, and/or in-person – are for their intended uses as defined by the content itself and elaborated only by TDS, and are for the direct use by only the purchaser of paid services, products, materials and programs, or by the public through general direct use of free content. Any other unauthorized use, duplication, representation, distribution or sale of trademarked, copyrighted or proprietary content, processes, materials or creations by those not officially representing TDS, either for profit or not, either for credit and representation or not, is strictly prohibited, and is subject to applicable laws, monitoring and enforcement that TDS might pursue. This applies to all such content, processes, material and creations that would be encountered through free website materials or videos, from social media posts, from paid website materials and videos, seminars, courses, classes, workshops, talks, dialogues, Q&As, consultation services, groups, commissioned materials or programs – be they via hard copy, online print, in-person, virtual, or recording – or by any other means and medium of encounter.
Sharing of passwords and sharing of access to password-protected registered content to non-registrants are strictly prohibited, and anyone found doing so will be immediately dismissed from registered programming with no refund, and may be subject to other consequences of intellectual-property infringement.
7. Undermining, Disruption, Hate and Trolling
TDS offers and uses certain ideas, premises, principles and processes (IPPPs) to equip people to increase Human Capacity in their life and work. The purpose of TDS services, activities and resources is to teach, elaborate and clarify these IPPPs; explore and relate their implications and applications; and for participants to share with and support each other during this learning in ways that enrich and inspire each other – they are not a forum to prove, defend, debate or challenge the IPPPs themselves.
From this perspective, TDS reserves the right and sole authority to address any client or participant whose words or actions persistently interrupt or undermine its processes (including during consultation services), or that disrupt the experience of forum for others (including virtual or in-person groups, seminars, workshops, courses, talks, dialogues, Q&As), or that attempt to turn these experiences into scenes for debating the underlying IPPPs.
TDS will also address any hateful words or behavior expressed or shown by any client or participant in any of its group fora.
TDS may also address any incidents of a participant/client violating confidentiality outside the group/forum.
Addressing such words/behavior could entail any or all of the following measures:
•Assessing the severity of such words/behavior
•Redirection of the words/behavior back toward the intended purpose of the service/activity – either privately or openly during the activity itself, either immediately or later
•Direct feedback about the words/behavior to the client/participant – either privately or openly during the activity itself, either immediately or later – with the expectation that such words/behavior will cease going forward, and in some cases with the expectation of an apology from the participant/client
•Determination when such a case of patterned words/behavior is irremediable or egregious enough to warrant removal
•Removal of an irremediable or egregious participant/client from the activity or service, +/- occasional termination of service/access to a client/participant – based on the severity/intractability of disruption
The appraisal, execution, sequence, timing, brevity, protraction, privacy or openness of these measures will solely be the at the judgment and discretion of Talisman Development Services.
TDS reserves the right to openly and publicly address any trolling by such clients/participants within or outside TDS’s own settings, or to choose not to. In cases where TDS does address it, this could entail explanation of the client/participant’s behavior in TDS settings, including possible sharing of any record of an incident or pattern of behavior.
8. Talisman’s Privacy Policy
We respect your privacy and do not tolerate spam and will never sell, rent, lease or give away your information (name, address, email, etc.) to any third party. In order to prevent unauthorized access, we use strict security procedures in the storage and disclosure of information which you have given to us. We take all reasonable precautions to ensure the security of personal data stored on our password protected system. You can contribute and reciprocate by not sharing passwords or distributing password-protected content.
9. Talisman’s Non-Discrimination Policy
TDS operates on the values of respect and integrity for those we serve, believing our services should be available to all people. We are committed to providing an inclusive environment for everyone engaging our organization – including (though not limited to) receiving of services, employment, membership, volunteer service, partnership, or engagement with TDS in other matters. We do not exclude or treat people differently because of age, race, color, religion, gender, ethnicity, national origin, disability, marital status, sexual orientation, or military status.
10. Consent and Agreement
I, the TDS participant/client, agree to be completely forthcoming with respect to whom I represent (i.e. myself, relative, or any other person, company, association, and/or governmental agency). I understand that sharing of passwords, and sharing of access to password-protected registered content and programs (online courses, paid online talks, special online groups and dialogues) with non-registrants, are strictly prohibited, and anyone found doing so will be immediately dismissed from registered programming with no refund. I understand that TDS reserves the right to modify at any time the content and delivery of all TDS training courses and modules, and evolve at any time the nature, process and content of consultation services, talks, dialogues, groups, courses, seminars, workshops, videos, reading materials, and other development services and products. I understand that registration fees for TDS courses, and prices for all TDS products and services, are subject to change at any time; that such changes would not apply to programs or services already registered or purchased; and that such changes would apply to new purchases or renewed registrations going forward. I understand that agreement with these Policies, Terms, Conditions and Compliances constitutes a contract subject to monitoring and enforcement. By registering for any TDS program, I agree to comply with TDS’s Cancellation Policies, all TDS Terms and Conditions and Trademark Compliance.
11. Terms
By accessing the website at talismanmd.com, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.
12. Use License
Permission is granted to temporarily download one copy of the materials (information or software) on Talisman Development Services’s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
- modify or copy the materials;
- use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
- attempt to decompile or reverse engineer any software contained on Talisman Development Services’s website;
- remove any copyright or other proprietary notations from the materials; or
- transfer the materials to another person or “mirror” the materials on any other server.
This license shall automatically terminate if you violate any of these restrictions and may be terminated by Talisman Development Services at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
13. Disclaimer
The materials on Talisman Development Services’s website are provided on an ‘as is’ basis. Talisman Development Services makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
Further, Talisman Development Services does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.
14. Limitations
In no event shall Talisman Development Services or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Talisman Development Services’s website, even if Talisman Development Services or a Talisman Development Services authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
15. Accuracy of materials
The materials appearing on Talisman Development Services’s website could include technical, typographical, or photographic errors. Talisman Development Services does not warrant that any of the materials on its website are accurate, complete or current. Talisman Development Services may make changes to the materials contained on its website at any time without notice. However Talisman Development Services does not make any commitment to update the materials.

Talisman Development Services has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Talisman Development Services of the site. Use of any such linked website is at the user’s own risk.
17. Modifications
Talisman Development Services may revise these terms of service for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.
18. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of Pennsylvania and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
